K&L Gates was one of the first international firms to enter the South Florida market. Our Miami lawyers practice throughout Florida and serve as a principal connection with our Latin America practice.
The focus of the Miami office practice is commercial litigation, domestic and international corporate and securities work, employment law, bankruptcy and debtor/creditor matters, white-collar criminal representation, products liability defense, financial institutions, real estate, probate and estate, public accommodations ADA representation and electronic commerce and technology.
The Miami office handles complex litigation for a wide range of business clients, including leading financial institutions, manufacturing enterprises, prominent retailers, health care providers, accounting firms, broker-dealers and individuals. The lawyers in the Miami office have handled some of the most significant lawsuits in Florida. We represent business clients in a broad array of commercial disputes, including deal litigation, contract interpretation, corporate governance, real estate, class actions, employment and labor, civil rights, construction, mortgage banking, insurance coverage, bankruptcy and workouts, intellectual property, products liability and toxic torts and international disputes. We counsel clients in internal company investigations and guide them through investigations by state attorneys general or by the federal government. Our Miami litigators practice throughout Florida and have handled matters in over two dozen other states. We also represent clients in appellate matters and our lawyers have argued in a number of appellate courts, including the Florida Supreme Court and the United States Supreme Court.
The Miami corporate group provides guidance to its clients on investments, transactions and compliance matters. Our primary areas of focus include mergers and acquisitions, private equity and venture capital, corporate finance and capital markets (including public and private securities offerings), emerging companies, corporate governance, joint ventures and strategic alliances, cross-border transactions and general corporate services. Our clients range from large, publicly owned corporations to entrepreneurs involved in the formation and financing of start-up ventures. We help our clients secure the financing they need to grow, complete the deals that make growth a reality and comply with all the complex regulations of corporate conduct.
In bankruptcy and debtor/creditor matters, we represent secured and unsecured creditors, acquirers of assets and operations, bond and debenture holders and creditors' committees. These engagements include significant representations of banks, private equity investors and asset-based lenders in proceedings under Chapter 11 of the Bankruptcy Code. Our lawyers also represent creditors in state court liquidations and commercial mortgage foreclosures and give strategic advice to companies that conduct business with financially distressed entities.
Our employment and labor lawyers offer our employer clients a robust practice encompassing day-to-day advice and counsel, defense of employment disputes and investigations, wage and hour actions, workplace safety claims, ADA employment issues and business transaction support. Our lawyers also have extensive experience handling restrictive covenant disputes, including non-competes, confidentiality and non-solicitation issues.
Our product liability practice has extensive experience in product liability litigation, having handled a wide variety of cases at the trial and appellate levels in state and federal courts in Florida and a number of other jurisdictions across the United States. Lawyers in the group have defended and tried cases involving many types of industrial machinery and equipment, marine products and numerous other consumer products. In addition to defending and trying individual cases, group members have served as national coordinating counsel and regional and national defense trial counsel for numerous clients in product liability cases.
Our real estate lawyers handle every area of real estate matters, including secured lending, purchase, sale and lease transactions. The office handles not only the transactional aspect of real estate but also represents clients in significant real estate litigation matters. We also provide our property owner clients with a wide array of counseling and litigation experience in the defense of discrimination in public accommodations claims under the ADA.
Our construction and infrastructure lawyers represent significant players in the construction industry and have experience on some of the largest and most complex projects in South Florida and Latin America. Lawyers in this group have provided front-end transactional and contract advice; and have defended and prosecuted claims in the courts, domestic and international arbitration and before DRBs and other forms of ADR. Our construction team has the knowledge to quickly master and understand the facts of a dispute, because they worked in the construction industry prior to practicing law.
Our private clients/trusts and estates practice counsels high net worth individuals on complex estate, tax and business planning, providing a unique solution to each client we serve. This office also administers large estates throughout the state of Florida, often involving ongoing negotiations with the IRS.
We also take great advantage of our location in Miami, the commercial gateway to Latin America and have a vibrant international practice. We represent both domestic and foreign clients in connection with inbound and outbound international transactions, with a particular emphasis on commerce involving Latin America.
Our international arbitration practice focuses on Latin America, as Miami is often the preferred neutral location for disputes arising out of the Caribbean, Central America and South America because of its lower costs, cultural compatibility, multilingual professional force and special international arbitration court division. Our lawyers have experience arbitrating claims pursuant to various frameworks, including International Chamber of Commerce (ICC) and American Arbitration Association (AAA) rules. In addition to formal arbitrations, our group has often worked with clients to avoid disputes before they arise and reduce the risk of a protracted resolution.
