The position of in-house counsel and directors has become increasingly risky due to extra-territorial regulation – which often results in unexpected consequences. Risk awareness and an understanding of D&O insurance are critical first steps to managing this exposure.

Yet many executives and directors are not fully aware of their exposure or D&O insurance coverage:

  1. What types of claim does your D&O policy cover?
  2. Will the policy respond if you are accused of fraud or dishonesty?
  3. Will D&O insurers provide financial support if you are arrested, extradited or deported?
  4. Will the D&O policy respond if you are drawn into an investigation concerning the affairs of your company?
  5. Will the D&O cover be compromised if notification of a claim or potential claim is not given in a timely manner?
